Attorneys for Anderson County death row inmate Rodney Roberson have filed a petition with the Texas Court of Criminal Appeals, seeking a declaration of innocence or a new trial.

The case gained attention last fall when a Texas House committee blocked Roberson’s execution, arguing he was wrongly convicted of killing his daughter by shaken baby syndrome. The committee contends the child died from a respiratory disease, not abuse.

During a recent hearing, a juror from the original trial testified that they were never informed of the potential respiratory condition.

Despite the new claims, the Texas Attorney General’s office maintains that Roberson received a fair trial and should be executed as scheduled.

The court has not yet indicated when it will rule on the petition.
