Judge: Texas DPS does not have to turn over records about response to Uvalde shooting

A judge has ruled the Texas Department of Public Safety (DPS) does not have to turn over records about the response to the Uvalde shooting.

Texas State Senator Roland Gutierrez sued the the DPS in June to try to force the agency to turn over records of the response to the Uvalde elementary school shooting.

Gutierrez wrote in the lawsuit, the people of Uvalde and Texas are demanding answers but were met with lies, mis-statements and shifts of blame.

DPS officials wanted to keep the records secret, saying the release of information could compromise investigations by state police, Texas Rangers and the FBI.

A judge has now ruled those records can stay secret at least temporarily, not ruling on whether state police can withhold records about their response, only saying Gutierrez had not filed his request properly under the Texas Public Information Act, so DPS had no obligation to fulfill it.

Gutierrez said he plans to appeal the court's order and submit a new request.
