EAST AURORA, N.Y. (WBEN) - The East Aurora woman accused of hitting a nine-year-old girl with her car on Sunday surrendered her driver's license after the judge said they realized their error during Monday's arraignment.
Erin Kuntz, 30, gave her license to the court on Tuesday afternoon after she charged with a DWI and vehicular assault early Monday morning. During her initial arraignment, she did not give up her license despite laws that said she needed to. Judge Jeffrey Markello said that there was no representative from the Erie County District Attorney's Office on Monday but further review of the traffic laws led to the East Aurora woman losing her license.

July 23, 2019 Kuntz and her attorney declined comment after Tuesday's court appearance.
The East Aurora woman allegedly struck the girl on Sunday evening on East Main Street in the Village of East Aurora. Kuntz tried to drive around a parked vehicle and struck the girl, who was on a scooter, on the sidewalk. The girl suffered serious injuries and was taken to Oishei Children's Hospital.
Kuntz faces four years in prison. She was charged with second degree vehicular assault, a DWI, unlawful possession of marijuana, and two vehicle and traffic law violations. She refused a breath test.
