NEW YORK (WCBS 880) — A Manhattan family court judge has set a trial date for the 13-year-old charged in connection with the fatal stabbing of Tessa Majors.
Judge Carol Goldstein ordered the 13-year-old suspect remain jailed until his March 16 trail, noting the seriousness of the second-degree murder charge against him.
Defense attorneys argued the teenager should be released to the custody of his aunt and uncle because he is not a flight risk, but the judge disagreed.
She also set a Feb. 4 hearing to rule on a request that certain evidence in the case be suppressed, according to the New York Post.
The middle schooler was arrested two days after the Barnard College freshman was stabbed to death during a botched mugging in Morningside Park.
He is one of three teens police believe were invovled.
Police are waiting for results of lab tests on DNA taken from a 14-year-old they believe was the one who actually stabbed Majors.
There was no word on whether the teen's statement to police could be used as evidence in the case. It’s believed that will be decided next month.
