Attorney: Lafourche A. I. deepfake porn victim can sue for damages

A 13-year-old Lafourche Parish public school student is facing charges after authorities say he shared fake nude photos of a female student. Those photos, officials say, were made with artificial intelligence, and the Lafourche Parish sheriff says more people could be arrested in connection with the case.

According to one attorney, the victim could pursue civil damages against the suspects.

"Under Louisiana law, you can probably do it under tort law for invasion of privacy (and for) intentional infliction of emotional distress," said Dough Sunseri, host of ALL THINGS LEGAL on WWL. "We call it a tort claim under Article 23:15--when you harm someone else or someone has a duty to you that they breach."

Sunseri says the 13-year-old victim can sue the person or people who created or shared the fake pictures of her.

"It is a definite invasion of privacy and it's a definite claim under intentional inflection of emotional distress," Sunseri said.

Sunseri says Congress is considering a similar bill.

"The pending federal legislation of giving statutory damages up to $250,000, that's pending in the Congress. It hasn't been signed yet."

The victim in the Lafourche Parish case was expelled from school after she allegedly hit the student who's accused of sharing the fake nude photos of her. The victim's attorneys say they plan to file a federal lawsuit against the school board over that expulsion.

Meanwhile, the sheriff's office says it will not bring charges against the victim because of the "totality of the circumstances."
