NORTHWEST Ind. (WBBM NEWSRADIO) -- It’s been an issue for many years in Northwest Indiana: The fairness of requiring vehicle emissions testing for residents of Lake and Porter Counties but not those living elsewhere. Now, the issue will be heard before a judge.
In the latest challenge to the program, A lawsuit filed by the Lake County Board received a hearing on Tuesday. The Northwest Indiana Times reports it was about whether the case can move forward and an attorney representing the board argued it's unconstitutional to treat residents of the region differently than others.
The attorney for the state argued that testing is required by federal law, because the region is tied to Chicago air quality standards. The judge promised a ruling soon.
During a 2018 hearing, Republican state rep. Ed Soliday of Valparaiso, said pollution comes largely from traffic on Interstate 80/ 94. He said it's not likely anything will change until there's a major change in how the Environmental Protection Agency thinks.
