A Western North Carolina police officer has been cleared of any wrong doing after crashing into a pedestrian, earlier this month.

As we previously reported, an officer with the Rutherfordton Police Department hit a pedestrian with his patrol car on South Main Street just after 4AM on the morning of October 8th.

The District Attorney's Office says the pedestrian was wearing dark colored clothes and it was dark and raining at the time. Officials say rumors that the victim was a reflective vest were false.

The pedestrian was reportedly walking in the roadway towards traffic. The North Carolina Highway Patrol lead the investigation and said the officer was driving under the speed limit at the time of the crash.

The DA's office says the officer did not violate any laws and therefore no charges will be filed.
