Nirvana finally responds to 'Nevermind' baby lawsuit

The band issued a formal statement calling it "not serious"

Earlier this year, Nirvana fans were shocked when the baby featured on the iconic 'Nevermind' album cover, now an adult, filed a lawsuit against the band for the use of his image. Now, months later the band has finally responded. In a formal statement issued by the band, Nirvana called the lawsuit "not serious."

Spencer Elden filed a lawsuit against Nirvana back in August, claiming the use of his image was "child pornography." However, the band is now claiming the lawsuit was filed well after the statute of limitations, as federal child pornography law has a 10-year statute of limitations. The statement also points out, Elden was well aware he was the baby featured on the cover, as he has spent years profiting off the image.


According to UPROXX, the statement claims that Elden "has spent three decades profiting from his celebrity as the self-anointed 'Nirvana Baby,'" noting that he has "re-enacted the photograph in exchange for a fee" multiple times. In the end, the band doesn't seem too worried about the lawsuit. Hopefully this doesn't end poorly for them.
