These days, a movie theater is a pretty nice play to kick back and have a nice meal and cocktail.  Watching a new movie just happens to be a great perk.

Unfortunately, one North Texas man is claiming that a national theater chain is deceiving customers and has filed a class action lawsuit as a result.

Shane Waldrop has filed a lawsuit against Cinemark over claims that their 24-ounce beer cups don't actually hold 24 ounces at all!

According to FOX 4, his lawsuit reads, "This is especially misleading because the 24 oz drink should provide a deal for consumers over the 20 oz drink's price: $0.37 per ounce vs. $0.39 per ounce. But due to the actual volume of 22 oz available in the '24 oz' drink, the price is $0.40 per ounce making the larger drink more expensive per ounce, which is not a deal at all."

Waldrop says he brought the lawsuit for himself and "all other persons nationwide."

He is seeking a jury trial.  Cinemark has not responded to the suit.
