The Republican Party is taking the side of Mehmet Oz in the legal fight over undated mail-in ballots in Pennsylvania's neck-and-neck GOP U.S. Senate primary.

The RNC and state Republican party are opposing a lawsuit by David McCormick, who's asking a state court to require counties to count mail-in ballots with no handwritten date on the return envelope.

In an interview with Marty Griffin on NewsRadio KDKA, Attorney Tom King represents both the RNC and state GOP. He says state law requires a date.

“There’s clear instruction on these things. You place the date, what day did you vote and you write it on the envelope. It’s a matter of whether state law matters or not.”

Oz leads McCormick by 992 votes, a margin small enough to trigger Pennsylvania's automatic recount law.

Tuesday is the deadline for counties to report unofficial results to the state.
