AG Paxton sues Xcel Energy over Smokehouse Creek Fire

Texas Attorney General Ken Paxton has filed a lawsuit in the aftermath of the largest wildfire in recorded Texas history.

The Smokehouse Creek Fire led to the deaths of three Texans and left over $1-billion in damage.

The lawsuit is filed against Southwestern Public Service Company which operates in Texas as Xcel Energy.

Paxton accuses Xcel of negligence and claims the company made false representations about its safety commitments.

The Attorney General's office says Xcel admitted a utility pole was the start of the wildfire.

Xcel said in a statement that they are deeply disappointed that the Attorney General decided to pursue the litigation.

"Though Xcel Energy disputes claims that it acted negligently in maintaining and operating its infrastructure, we accepted responsibility from the beginning and set up an expedited claims process," Xcel said.

"When the Attorney General's office approached us earlier this year requesting information, we worked with them in good faith to try and find a consensus solution. They chose to file litigation instead."
