GARLAND (1080 KRLD)- The Garland man accused of driving his teenage son to and from a shooting two years ago is standing trial for capital murder. A jury is expected to be seated today and testimony begins Tuesday in the trial of Richard Acosta, 34, Garland.
Police do not believe Acosta actually fired a gun at a Garland convenience store the day after Christmas, 2021. But they think he did drive his 14-year old son to the store, and then drove him away after the shooting.
Abel Acosta has been on the lam since three were murdered and a fourth was wounded. A video clip shows a man firing into the store, killing Xavier Gonzales, 14, Ivan Noyala, 16 and Rafael Garcia, 17. 20-shots were fired. The video shows the gunman getting into a pickup truck, then speeding away.
Police say the elder Acosta was the driver, which is why they can charge him with capital murder under the Texas Penal Code.
Police think Abel Acosta may have fled the country.
If convicted the penalty is automatic life without parole.
