One of the two surviving members of the cop-killing Texas Seven prison escapees may get a new trial.

Four of the seven have already been executed for the Christmas Eve 2000 murder of Irving police officer Aubrey Hawkins.

Irving police chief at the time --  Jeff Spivey -- is not happy to hear Randy Halprin may get a new trial. But he acknowledges "...the ruling has been made and the law has to be followed."

Halprin claims that his trial judge in Dallas was anti-Semitic and therefore Halprin -- who is Jewish -- says he didn't get a fair trail.

Because the judge's daughter works in Dallas County District Attorney John Creuzot's office, Creuzot recused himself and the case was taken up by the Tarrant County District Attorney who now recommends Halprin get a new trial.

The Texas Court of Criminal Appeals will make the final decision.
