PHILADELPHIA (KYW Newsradio) — U.S. Marshals have arrested the fifth and final suspect wanted in connection to the fatal shooting of 14-year-old Nicolas Elizalde outside Roxborough High School last year.

They say 17-year-old Dayron Burney-Thorn, who was on the run for more than a year, was arrested in Germantown Monday around 1:45 p.m. He reportedly jumped out of a fourth-floor window at the Lenox Apartments on West Walnut Lane in an attempt to avoid arrest.

Authorities say Burney-Thorn is one of five people who ambushed Elizalde and four others at the end of a football scrimmage outside Roxborough High School on Sept. 27, 2022.

In January, murder charges were upheld for the other four suspects — Saleem MillerTroy FletcherZyheid Jones, and Yaaseen Bivins — who were also involved in the shooting.

Authorities say they developed information over the past few months that he may be back in the Philadelphia area. Early Monday, they were able to locate him at the apartment on West Walnut Lane.

Upon arrival, Marshals surrounded the complex, knocked on a door and announced their presence. After an attempt to stall them, Burney-Thorn opened the fourth-floor window and jumped out, wearing just boxers and a tank top.

They say Task Force Officers were on the ground and struggled with the 17-year-old before taking him into custody and taking him to a local hospital for medical treatment.

Authorities say Burney-Thorn was also wanted for a separate homicide that happened just one day before the Roxborough shooting, on Sept. 26, 2022, along the 600 block of North 13th Street.

The other suspects, Fletcher, Jones, Miller, and Bivens have a status hearing scheduled for Wednesday.
