Process server says AG Ken Paxton fled his McKinney home to avoid subpoena

An affidavit filed in federal court claims Attorney General Ken Paxton fled his McKinney home to avoid being served a subpoena on Monday.

A process server named Ernesto Herrera says he was trying to serve Paxton with papers to appear at a hearing on a lawsuit filed by abortion groups.

Herrera says Paxton got away in a pick-up driven by his wife, State Senator Angela Paxton.

Herrera says he clearly identified himself and his purpose multiple times but Paxton avoided him by running from his home and jumping in the truck as Mrs. Paxton drove off. Herrera says he then laid the paperwork in the driveway.

Paxton says he was motivated by concerns for his family's safety.
