Fallen Jefferson Parish Sheriff's Office deputy Christopher Ohlmeyer will be laid to rest tomorrow. Meanwhile, the investigation into the crash that killed him continues.
Investigators said that Ohlmeyer was killed while stopping traffic on his motorcycle as part of a funeral procession last week. The deputy was struck from behind by a woman driving an automobile.
Fatal crashes don't often lead to criminal charges, says Loyola School of Law Professor Dane Ciolino, unless investigators find some aggravating circumstances, like drunk driving or some other irresponsible behavior.
"The driver was driving in a reckless manner or driving in excess of the speed limit or perhaps was demonstrably distracted," Ciolino said. "You could envision situations like that where, absent impairment, the D.A. would be interested in seriously considering the case for criminal prosecution."
Ciolino said that without those extenuating circumstances, civil penalties sought by the deceased's family are usually the extent of the legal system's involvement.
