
SPRINGFIELD, Ill. (WBBM NEWSRADIO) -- Chicago Public Schools has won the latest round in a court battle over COVID requirements for teachers.
The fourth district Illinois Appellate Court in Springfield vacated the temporary restraining order issued by a Sangamon County Court two weeks ago. The order prevented CPS from taking action against six teachers who refused to submit proof of vaccination or undergo weekly tests for COVID.
The appellate court said that requiring a weekly test is non-invasive, non-harmful, free and readily available.
“While it may be questionable why only unvaccinated employees are required to take these weekly tests, the tests and the manner defendant makes the tests available to its employees do not appear unreasonable,” Judge John W. Turner of the 4th District Appellate Court in Springfield, wrote in a unanimous decision.
So for now, CPS can enforce the requirement that teachers who refuse to submit proof of vaccination get the weekly COVID tests while a lawsuit challenging the practice continues in another courtroom.
